1. Scope of Services:

Our Live Scan Fingerprinting service provides electronic fingerprinting and background check services to individuals and organizations. We use state-of-the-art technology to capture and transmit fingerprints to the appropriate authorities for processing.

2. Consent and Authorization:

By using our service, you consent to having your fingerprints captured and submitted for the purpose of a background check or other authorized use. You understand that the information obtained from the fingerprint submission may be used by government agencies and other authorized entities to verify your identity and conduct criminal history or other background checks.

3. Fees and Payments:

Our service fees are clearly displayed on our website and in our pricing information. Payment for our services is due at the time of booking. We accept various forms of payment, including cash, credit/debit cards, and electronic transfers. Payment will be required prior to performing any services. All fees are subject to change without prior notice.

4. Cancellation and Rescheduling Policy:

We understand that plans can change, which is why we offer the following flexible policies:

Any reservation can be cancelled with a full refund if you notify us by the close of business (5:00 PM CDT, Monday-Friday) the day before your booking. You are welcome to reschedule your booking at any time with no additional fees.

5. Missed Appointments:

Missed appointments are not eligible for a refund, but can be rescheduled for a more convenient time. If you are unable to attend your scheduled appointment, please contact us as soon as possible to reschedule. We understand that unexpected circumstances can arise, and we are happy to work with you to find a new time that better fits your schedule.

6. Tardiness Policy:

If you arrive more than 10 minutes late to an appointment, your reservation can no longer be guaranteed. In this case, we will happily rebook you to the next available opening and get you in as soon as possible without sacrificing the experience of our other clients. This policy is in place to ensure that all clients receive the high-quality experience they expect and deserve. Arriving on time allows us to provide the full attention and care to each person without disrupting the schedule. We understand that unexpected delays can happen. If you anticipate being more than 10 minutes late, please let us know as soon as possible. We'll do our best to accommodate you, but cannot guarantee availability if the delay is significant.

7. Confidentiality and Data Protection:

We take the privacy and security of your personal information very seriously. All data collected during the fingerprinting process is transmitted securely and stored in accordance with applicable laws and regulations. We will not share or disclose your personal information to any third parties without your explicit consent, except as required by law or authorized government agencies.

8. Limitations of Liability:

We make every effort to provide accurate and reliable services, but we cannot guarantee the outcome or results of any background check or fingerprint submission. We shall not be liable for any direct, indirect, or consequential damages arising from the use of our services, including but not limited to delays, errors, or omissions in the fingerprinting or background check process.

These terms of service shall be governed by and construed in accordance with the laws of Texas and the United States.

You agree not to engage in any of the following prohibited activities in connection with our fingerprinting services:

• Violating any applicable laws or regulations;

• Infringing upon the rights of others;

• Interfering with or disrupting our fingerprinting services;

• Attempting to gain unauthorized access to any portion of our fingerprinting services;

• Using our fingerprinting services for any unlawful or unauthorized purpose.

7. Intellectual Property:

All content included in our fingerprinting services, including but not limited to text, graphics, logos, images, and software, is the property of the Company or its licensors and is protected by intellectual property laws.

8. Disclaimer of Warranties:

Protrace Fingerprinting offers complimentary reprints for any rejected services due to technical errors, typos, or unaccepted live scans. This reprint policy is valid for up to 60 days after the initial rejection. However, Protrace Fingerprinting is not liable for rejections caused by client submission errors, clients not adhering to the specific instructions provided during the process or clients providing inaccurate or misleading information during the intake stage.

This reprint policy is designed to ensure that clients receive high-quality fingerprinting services and are not penalized for minor technical issues beyond their control. Protrace Fingerprinting is committed to delivering reliable and accurate results while maintaining a transparent and customer-focused approach.

9. Limitation of Liability:

Protrace Fingerprinting's liability for any claims, losses, damages, or expenses arising from the use of its services shall be limited to the amount paid by the client for the specific service(s) giving rise to the claim. In no event shall Protrace Fingerprinting be liable for any indirect, special, incidental, or consequential damages, including but not limited to lost profits or business interruption, regardless of the form of action, whether in contract, tort, or otherwise.

11. Changes to Terms:

We reserve the right to modify or update these Terms at any time without prior notice. The most current version of these Terms will be posted on our website. Your continued use of our fingerprinting services after any such changes constitutes your acceptance of the new Terms.
